Rack Viewer: Terms of Service

These Terms of Service ("Terms") govern your purchase and use of the Rack Viewer desktop application ("the Software"), developed by Elevation Technology Solutions ("we," "us," "our"). By downloading, installing, purchasing a license for, or using the Software, you agree to these Terms. If you do not agree, do not use the Software. Questions? Email elevationtechnology@outlook.com.

1. What is free and what is paid

Viewing is free, forever. Browsing photos and video, marking keepers, zooming, full screen and video playback with sound are free to use for as long as you like, with no license, no account and no time limit.

One feature is paid: the Keeper Cleanup, moving every non-keeper in a folder to your trash folder in a single action. You get 10 free Keeper Cleanups to evaluate it. After that, running further Keeper Cleanups requires a paid license. Everything else keeps working either way.

2. Free trial: try before you buy

The 10 free Keeper Cleanups let you fully evaluate the Software, including exactly how it moves and organizes your files, on your own photos and your own computer before paying anything. We encourage you to use them before purchasing. The count is kept on your own computer and is not reported to us.

3. License

• What you get. A paid license grants you a personal, non-exclusive, non-transferable right to use the Software, including unlimited Keeper Cleanups, on your own trail-camera photos and video.
• All versions. Unlike some of our other products, a Rack Viewer license is not tied to a version number. It unlocks the version you bought and all future Rack Viewer releases.
• One computer. Each license code activates on one computer. First activation requires a one-time internet connection; afterward the Software runs entirely offline.
• If you are offline when you buy. A code entered while the Software cannot reach our activation server keeps working for two days of app use: counted in days you actually run it, not calendar days, so a gap between seasons costs you nothing. Activation is retried automatically each time you have a connection. If it never succeeds within those two days, Keeper Cleanups stop until it does.
• Transfers. Using Detach License in the Software's settings removes the license from that computer and returns it to the free trial. The code remains yours and can be entered on that same computer again at any time. Moving a license to a different computer requires us to release it first. Email us and we will take care of it.
• Included with Rack Detector. Purchasing a Rack Detector license also entitles you to a Rack Viewer license. The two products use separate codes; a code issued for one will not activate the other.
• Restrictions. You may not share, resell, sublicense, or publish your license code; and you may not reverse-engineer, decompile, or redistribute the Software, except to the extent this restriction is prohibited by law.

4. Payment and refunds

Payments are processed by Stripe; we do not receive or store your full payment-card details. License codes are typically delivered by email within 24 hours of purchase (usually sooner).

All sales are final and license codes are non-refundable. Because the 10 free Keeper Cleanups let you fully evaluate the Software on your own files before purchasing, we do not offer refunds. If your license code will not activate, or the Software will not run on a supported system, contact us and we will work with you to resolve it.

5. The Software moves your files: keep backups

This is the most important thing on this page. A Keeper Cleanup moves files on your computer: everything in the folder that you have not marked as a keeper is moved into the trash folder you have chosen.

• Nothing is deleted by the Software. Files are moved, not erased. Emptying the trash folder is a separate action that only you can take.
• Check your keepers first. Which photos are worth keeping is your decision, and the Software carries it out exactly as marked. Confirm your keeper list and your trash folder location before running a Keeper Cleanup.
• You are responsible for your own backups. Keep a copy of any photos or video you cannot afford to lose. To the extent permitted by law, we are not liable for lost, moved, overwritten or unrecoverable files, however caused, including interruptions such as a power loss or a disconnected drive during a move.

6. Your photos stay on your computer

The Software displays and moves your files entirely on your own computer; your photos and video are never uploaded to us. If you never enter a license code, the Software makes no network connections at all. See our Privacy Policy for the limited information collected during license activation.

7. Disclaimer of warranties

The Software is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Software will be error-free or uninterrupted, that it will display or play every file format, or that it will run at any particular speed on your hardware.

8. Limitation of liability

To the maximum extent permitted by law, Elevation Technology Solutions will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, files, or goodwill, arising out of or related to your use of the Software. Our total liability for any claim relating to the Software will not exceed the amount you paid for your license.

9. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Software after a change constitutes acceptance of the revised Terms.

10. Governing law

These Terms are governed by the laws of the State of Utah, USA, without regard to its conflict-of-laws rules.
